Who It Is For

• Italian citizens who have established their habitual residence in the municipality
• EU citizens who have established their habitual residence in the municipality and come from abroad, provided they can document legal residency under Legislative Decree 30/2007
• EU citizens who have established their habitual residence in the municipality and come from another Italian municipality, legally residing under Legislative Decree 30/2007
• Non-EU citizens who have established their habitual residence in the municipality with lawful stay documentation

La residenza che si ottiene con l’iscrizione anagrafica consente di acquisire dei diritti e dei doveri.

La residenza ha un valore amministrativo in quanto permette di localizzare un soggetto all’interno di un determinato territorio comunale.

Ma ha anche un valore costituzionale perché rende possibile accedere a dei diritti:

• Art. 4 Cost., c.1, “La Repubblica riconosce a tutti i cittadini il diritto al lavoro e promuove le condizioni che rendano effettivo questo diritto”: senza la residenza non ci si può iscrivere al Centro per l’impiego e non si può aprire una partita IVA.
• Art. 24 Cost., c. 1, 2 e 3, “Tutti possono agire in giudizio per la tutela dei propri diritti e interessi legittimi. La difesa è diritto inviolabile in ogni stato e grado del procedimento. Sono assicurati ai non abbienti, con appositi istituti, i mezzi per agire e difendersi davanti ad ogni giurisdizione.”: senza residenza non si ha accesso al gratuito patrocinio.
• Art. 32 Cost., c. 1, “La Repubblica tutela la salute come fondamentale diritto dell’individuo e interesse della collettività, e garantisce cure gratuite agli indigenti.”: senza la residenza non si può accedere al Servizio Sanitario Nazionale scegliendo un medico di base e non si può usufruire delle esenzioni previste.
• Art. 38 Cost. c. 1, “Ogni cittadino inabile al lavoro e sprovvisto dei mezzi necessari per vivere ha diritto al mantenimento e all’assistenza sociale.”: senza residenza non si ha accesso ai servizi di welfare locale (assistenza sociale), e non si può percepire una pensione sociale o d’invalidità.
• Art 48 Cost., c. 2, “Il voto è personale ed eguale, libero e segreto. Il suo esercizio è dovere civico.”: senza residenza non si appartiene a nessuna circoscrizione elettorale, quindi non si può votare.

La residenza comporta anche dei doveri:

• la ricezione di raccomandate
• questioni fiscali
• doveri legati al nucleo familiare

The residence obtained through registration in the civil registry allows individuals to acquire certain rights and duties.

Residence has administrative value because it allows a person to be located within a specific municipal territory.

However, it also has constitutional value because it allows to access certain rights:

• Art. 4 of the Constitution, para. 1: “The Republic recognises the right of all citizens to work and promotes those conditions which render this right effective.”: without residence, one cannot register with the Employment Center nor open a VAT number.
• Art. 24 of the Constitution, paras. 1, 2 and 3: “Anyone may bring cases before a court of law in order to protect their rights under civil and administrative law. Defense is an inviolable right at every stage and instance of legal proceedings. The poor are entitled by law to proper means for action or defense in all courts.”: without residence, one cannot access legal aid.
• Art. 32 of the Constitution, para. 1: “The Republic safeguards health as a fundamental right of the individual and as a collective interest, and guarantees free medical care to the indigent.”: without residence, one cannot access the National Health Service by choosing a general practitioner, nor benefit from available exemptions.
• Art. 38 of the Constitution, para. 1: “Every citizen unable to work and without the necessary means of subsistence is entitled to welfare support.”: without residence, one cannot access local welfare services (social assistance), nor receive a social or disability pension.
• Art. 48 of the Constitution, para. 2: “The vote is personal and equal, free and secret. The exercise thereof is a civic duty.”: without residence, a person does not belong to any electoral district and therefore cannot vote.

Residence also entails certain duties:

• receiving registered mail

• tax-related obligations

• duties connected to the family unit

Per chiedere l’iscrizione nell’anagrafe della popolazione residente deve essere compilato il modello unico ministeriale appositamente predisposto.
I dichiaranti devono compilare il modello autocertificando il possesso dei requisiti necessari per l’iscrizione in anagrafe. Le dichiarazioni sono verificate dall’Ufficio Anagrafe.

Come presentare o inviare la richiesta:

• compilato e sottoscritto presso l’Ufficio Anagrafe del Comune
• consegnato e sottoscritto presso l’Ufficio Anagrafe o all’Ufficio Protocollo completo di eventuali allegati e di copia di documento di identità del o dei sottoscrittori

La dichiarazione relativa al cambio di residenza deve essere fatta entro 20 giorni dall’effettivo trasferimento nella nuova abitazione.

How to Apply

To request registration in the resident population registry, you must fill in the dedicated official ministerial form. You must declare that you meet the requirements for registration. The Registry Office will verify the declarations.

How to submit or send the request:

• You can fill in and sign the form in person at the Municipality’s Registry Office
• You can deliver the signed form by submitting it to the Registry or Protocol Office, complete with any attachments and a copy of the identity document(s) of the signatory/signatories
• You can send the form by certified email (PEC) to the municipal protocol address protocollo.comune.casteldelci@pec.it, complete with any attachments and a copy of the identity document(s) of the signatory/signatories

What You Get

L’iscrizione viene registrata nell’anagrafe del Comune entro 2 giorni dalla ricezione della dichiarazione e resa definitiva entro 45 giorni sempre dalla ricezione della richiesta dopo che:

• è stata accertata l’esistenza della dimora abituale attraverso sopralluoghi anche ripetuti da parte della Polizia Municipale
• è stata verificata la completezza della documentazione allegata ne è stata inviata notizia ai cointeressati

A seguito della variazione di indirizzo deve essere compilato il modello dichiarazione TARI reperibile sul sito del comune o presso l’Ufficio Tributi

Il procedimento si conclude entro 45 giorni dalla richiesta. Qualora entro tale termine sia verificata la mancanza dei requisiti l’Ufficio Anagrafe può respingere la richiesta dopo aver inviato all’interessato comunicazione ai sensi dell’art. 10bis della legge 241/1990 contenente il preavviso di rigetto ed aver valutato le eventuali ragioni espresse dall’interessato stesso nei successivi 10 giorni.

Timing and deadlines

The registration is entered in the municipal registry within 2 days of receiving the form and becomes final within 45 days from the request, after:

• The Municipality verifies the existence of the habitual residence through inspections, including repeated ones, by the Municipal Police.
• The Municipality verifies that the attached documentation is complete and sends and a notification to the interested parties.

Following the change of address, the TARI (waste tax) declaration form must be completed. It is available on the Municipality’s website or at its Tax Office.

The process is completed within 45 days from the request. If, within this period, the required conditions are not met, the Registry Office may reject the request after sending a notification to the applicant(s) pursuant to Article 10-bis of Law 241/1990, which includes a notice of rejection, and after evaluating any reasons for the discrepancy provided by the applicant(s) within the following 10 days.
